TITLE
Recommendation to increase Contract No. 31075 with Dutra Construction, Inc., for the improvement of the Aqualink Landing at Belmont Veterans Memorial Pier in the amount of $225,000, to allow for emergency repair work needed on the Leeway Center dock. (District 3)

DISCUSSION
On March 3, 2009, the City Council awarded a contract to Dutra Construction, Inc., to replace an existing deteriorated timber (two-float) docking system with a new two-float docking system at Belmont Veterans Memorial Pier. The project was awarded in the amount of $1 ,464,134 funded with Proposition A Funds.

Recently during a low tide inspection of the dock located at the Leeway Sailing Center, staff became aware of piling and dock deterioration that needs to be repaired immediately, as shown on Exhibit A. Failure to make these safety repairs could result in the closure of the dock, affecting the ongoing Gondola concessions, summer youth sailing programs, and the CSULB sailing activities conducted at this facility. Dutra Construction is currently under contract with the City, and has the materials and expertise to immediately perform the required repairs. In order for this work to commence, their current contract authority must be increased by $225,000. The cost for these emergency repairs will be funded by budgeted Tideland Funds allocated for the renovation the Leeway Sailing Center.

This matter was reviewed by Deputy City Attorney Linda Trang on May 25, 2010 and by Budget Management Officer Victoria Bell on May 25,2010.

TIMING CONSIDERATIONS
City Council action on this matter is requested on June 15, 2010 to allow for the needed emergency repair work to the Leeway Sailing Center dock facility.

FISCAL IMPACT
This' action will increase the current allowable contract amount from $1,464,134 to $1,689,134. Sufficient funds to cover this contract increase are budgeted in the Tidelands Capital Fund (TF) in the Department of Parks, Recreation and Marine (PR).
