TITLE

Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend Contract No. 36235 with All American Asphalt of Corona, CA, for completion of the Market Street Pedestrian and Streetscape Project, to increase the contract amount by $3,207,203, and increase contingency on the contract to 20 percent in the amount of $2,120,321, for a revised total contract amount of $12,721,925.  (District 8)

 

DISCUSSION

City Council action is requested to amend Contract No. 36235 with All American Asphalt to continue construction work on the Market Street Pedestrian and Streetscape Project (Project).  The Project will implement a series of pedestrian and streetscape improvements along the 2.2-mile length of Market Street, from the Los Angeles River to 800 feet east of Cherry Avenue. 

 

On April 5, 2022, the City Council awarded a contract to All American Asphalt for the construction of the Project under Plans and Specifications R-7177 in the amount of $7,394,311, with a 12.5 percent contingency in the amount of $924,289, for a total contract amount not to exceed $8,318,600.

 

During the design development, the scope was intended to provide upgrades to major American Disability Act (ADA) deficiencies along the corridor.  However, prior to the start of construction, it was observed that a substantial number of additional existing improvements did not meet ADA requirements. The City of Long Beach (City), therefore, decided to upgrade all existing improvements in the corridor for ADA compliance and increased public safety.

 

To complete all improvements, an extensive design revision was required which realigns curb and gutter on both sides of Market Street along most of the corridor to facilitate a major change in scope with increasing amounts of replacement of sidewalks, curb, and gutters, driveways, handicap ramps, bus pads, striping and signage, streetlights, as well as storm drain modifications and fire hydrant relocations.

 

Due to the change in scope noted above, the project will exceed the original contract amount and contingency. The recommended increase will result in a new total contract amount not to exceed $12,721,925, inclusive of a revised 20 percent contingency which adds $2,120,321 within the total contract amount.

 

This matter was reviewed by Deputy City Attorney Vanesa S. Ibarra and by Budget Management Officer Nader Kaamoush on April 17, 2023, and by Purchasing Agent Michelle Wilson on April 7, 2023.

 

TIMING CONSIDERATIONS

City Council action to increase Contract 36235 is requested on May 2, 2023, to allow expeditious payment to the contractor. The Project is currently underway.

 

FISCAL IMPACT

This requested action increases the contract authority with All American Asphalt by $4,403,325, inclusive of adjusting the contingency to 20 percent. The total amount of the contract will not exceed $12,721,925 for the completion of the Project. The total cost of the Project is estimated at $15,715,557, including design, construction, construction management, inspection, labor compliance, and project oversight. The Project is supported by $2,838,000 of State Local Partnership Program (LPP); $2,653,163 of Federal Highway Administration (FHWA) Apportionment (STPL); $3,233,837 of FHWA Congestion Mitigation and Air Quality (CMAQ); $107,452 of Air Quality Management District (AB 2766); $21,000 of Metro Local Return Prop A; $799,931 of Metro Local Return Prop C; $500,000 of Metro Local Return Measure R; $1,416,000 of Metro Local Return Measure M; $1,500,000 of State Gas Tax, and $300,000 of State Transportation Development Act (TDA) funds and the remaining balance is anticipated from Federal Highway Administration (FHWA) Apportionment (STPL) in a possible amount of $2,347,000. There is sufficient appropriation to support the project in the in the Capital Projects Fund Group in the Public Works Department. No further appropriation is needed at this time. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
