TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend Contract No. 36153 with Los Angeles Engineering, Inc., of Covina, CA, for construction work on the El Dorado Duck Pond Rehabilitation Project, to increase the contract amount by $1,097,384, for a revised contract amount not to exceed $6,584,302. (District 4)
DISCUSSION
City Council approval is requested to amend Contract No. 36153 with Los Angeles Engineering, Inc., to continue increase the total contract amount to add a 20 percent contingency in the amount of $1,097,384 for a revised contract amount not to exceed $6,584,302 for construction work on the El Dorado Duck Pond Rehabilitation Project. The amendment requested to allow for necessary change orders due to escalation and field modifications for the urgently needed rehabilitation project.
On December 7, 2021, the City Council awarded a contract to Los Angeles Engineering as part of its adoption of R-7030 Rebid for construction services to complete end of 2023. At the time of contract award, no contingency was included in the award amount requested and approved.
The El Dorado Duck Pond, which holds roughly three million gallons of water, located in El Dorado Park West, is a major regional park located along the eastern border of the City of Long Beach (City). The area around the duck pond includes various recreational amenities and is a wildlife habitat. The Project will address leaks and other existing deficiencies in the duck pond infrastructure, improve public access, and include the installation of a reclaimed water irrigation system. For safety reasons, and since the pond will be drained as part of the proposed repairs, the pond will be temporarily closed to the public during construction.
The work to be done consists primarily of, but is not limited to, dewatering, sediment removal, site demolition, utility relocation, site grading, new sewer connection, new irrigation feeder line, utility relocation, site grading, new sewer connection, new irrigation feeder line, new reclaimed water line, realigned storm drain outlet, construction of sidewalk, construction of shoreline and wetland planters, construction of forebay and wetlands, ADA parking upgrades, new signage, replacement of the pump system, micron filtration and disinfection systems installation, structural repair of the pump building, removal and replacement of existing vegetation required for performance of the work, planting of native vegetation, Best Management Practices (BMP) installation, safety, and security controls, compliance with all permit requirements, and other work as shown in the approved plans and specifications.
To date, the project has seen increased costs due to construction delays for bird nesting and revised methodology and additional dewatering due to the unprecedented early winter rain. Total costs for these unforeseen increases comprise approximately 30 percent of the requested $1,097,384 contingency. Additonal change orders are pending for construction impacts due to unknown field conditions and additional improvements to the hardscape surrounding the pond.
This matter was reviewed by Deputy City Attorney Vanessa S. Ibarra on February 10, 2023, Purchasing Agent Michelle Wilson on February 9, 2023, and by Budget Management Officer Nader Kaamoush on February 16, 2023.
TIMING CONSIDERATIONS
City Council action to amend Contract No. 36153 is requested on March 7, 2023, to ensure there is no service interruption. The Project is time sensitive as the existing recirculation pumps are no longer operable, and much of the existing infrastructure continues to fall into major disrepair. To minimize impacts, the relocation of wildlife required for this Project must also be completed prior to the nesting season.
FISCAL IMPACT
The requested action increases the contract authority by $1,097,384 to add 20 percent contingency, for a revised contract amount not to exceed $6,584,302. The current project cost is estimated at $9,770,160 and includes the contract award amount of $6,584,302, inclusive of contingency, planning, design, permitting, construction, construction management, labor compliance, and project oversight. The Project is currently supported by $4,041,963 of Measure A funds, $3,796,013 of Measure W funds, $1,117,000 from the Water Department, $300,000 of grant funding from the Los Angeles County Regional Park and Opens Space District Grant, and $515,184 of one-time General Capital Funds budgeted in the Capital Projects Fund Group in the Public Works Department.
This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. Approval of this recommendation will provide continued support to the local economy by assisting in the preservation of employment for two full-time employees residing in Long Beach.
