Recommendation to adopt resolution authorizing City Manager, or designee, to execute all documents necessary to enter into an agreement with Downtown Long Beach Alliance, of Long Beach, CA, for enhanced services on 1st Street between Pacific Avenue and Long Beach Boulevard, and trash receptacles throughout the Downtown area, in an annual amount not to exceed $291,000, for a period of two years, with option to renew for three additional one-year periods, at the discretion of the City Manager. DISCUSSION

City Council approval is requested to enter into an agreement with Downtown Long Beach Alliance (DLBA), for enhanced services on 1st Street between Pacific Avenue and Long Beach Boulevard, and trash receptacles throughout the Downtown area.
In 1998, the City Council established the Downtown Long Beach Property and Business Improvement District (DLBPBID) for an initial period of five years, and subsequently extended the DLBPBID for three 10-year periods, with the current term in effect through December 31, 2032. Under the approved Management Plan, Downtown Long Beach Alliance (DLBA) is obligated to carry out certain upkeep operations in the downtown area.
Since 2013, DLBA has provided additional and enhanced services in the 1st Street Transit Mall over and above those listed in the DLBPBID Management Plan to ensure health, safety, and cleanliness of the community. DLBA has been reimbursed with Proposition A and Refuse/Recycling Funds to perform these additional services which have been critical in maintaining a clean and safe downtown area.
City Charter Section 1801 requires that contracts for City purchases be awarded to the lowest responsible bidder after a competitive bid process but allows for awards without a competitive bid process if accompanied by a Resolution of the City Council. The DLBA has been providing service in the designated DLBPBID area pursuant to the terms of the Management Plan. The additional maintenance service contemplated within the agreement is interconnected to the services already being provided and expands on the efforts DLBA is already performing. Entering into this agreement allows for a consistent maintenance approach within the downtown area. Bidding this additional work would not be expected to result in costs savings and would, if awarded to a different vendor, require additional staff efforts to coordinate between multiple entities providing a similar service within the same area.
This matter was reviewed by Principal Deputy City Attorney Richard Anthony on January 5, 2023, Purchasing Agent Michelle Wilson on December 28, 2022, and by Budget Management Officer Nader Kaamoush on January 4, 2023.
TIMING CONSIDERATIONS
City Council Action is requested on January 24, 2023, to allow for uninterrupted continuation of services.
FISCAL IMPACT
The total annual amount of the agreement will not exceed $291,000 for a period of two years, with option to renew for three additional one-year periods. The agreement will be funded by $225,000 from Proposition A funds and $66,000 from Refuse and Recycling funds. The Agreement is currently appropriated in the Capital Projects Fund Group in the Public Works Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. Entering in to this agreement will maintain the local jobs currently provided through DLBA.
