TITLE

Recommendation to adopt resolution authorizing City Manager, or designee, to execute a contract, and any necessary documents, including subsequent amendments, with Commercial Recreation Specialists, of Verona, WI, to purchase a custom Wibit water playground configuration for the Alamitos Beach Water Playground Project, in a total amount of $126,179, with a 15 percent contingency in the amount of $18,927, for a total contract amount not to exceed $145,106.  (District 2) 

 

DISCUSSION

City Council approval is requested to enter into a contract with Commercial Recreation Specialists (CRS) to purchase a custom Wibit water playground configuration for the Alamitos Beach Water Playground Project (Project).

 

The Project includes the installation of a new inflatable Wibit water playground off the shore at Alamitos Beach (Attachment A). The Wibit water playground will be configured in a figure-eight shape to connect multiple play structures such as slides, towers, and monkey bars (Attachment B). The water playground will be used during the summer each year for a five-year period.

 

Wibit equipment is currently used at the Bayshore Water Playground. Inflatable play structure manufacturers only produce products in their brand specific materials and colors. Wibit equipment will be used at Alamitos Beach for continuity of maintenance equipment and repair and colors of materials. CRS is the only supplier of Wibit equipment being used for the Project.

 

City Charter Section 1801 requires that contracts for City purchases be awarded to the lowest responsible bidder after a competitive bid process, but allows for awards without a competitive bid process if accompanied by a Resolution adopted by the City Council.

 

This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley on December 9, 2021, Business Services Bureau Manager Tara Mortensen on December 15, 2021, and by Budget Operations and Development Officer Rhutu Amin Gharib on December 17, 2021. 

 

TIMING CONSIDERATIONS

City Council action is to adopt a Resolution and award a contract concurrently is requested on January 18, 2022, to ensure the contract is in place expeditiously.

 

FISCAL IMPACT

The total amount of the contract will not exceed $145,106, inclusive of a 15 percent contingency.  The total Project is estimated to cost $400,000, which includes the contract award, consulting services, design, plan check, permit inspection and fees, construction support, project labor compliance, and related project support. Sufficient funds for the project are currently appropriated in the Tidelands Capital Fund within the Tidelands Operating Fund Group in the Public Works Department.

 

On August 23, 2019, the State Lands Commission (SLC) approved expenditures for the Project. All SLC requirements have been met, and the City is ready to proceed with construction.  The Parks, Recreation, and Marine Department will be responsible for operating and maintaining  the Project site upon completion. The annual operating and maintenance costs are currently unknown and unbudgeted in the Tidelands Operations Fund Group in the Parks, Recreation, and Marine Department. The Department will return to Council if operating and maintenance costs incur in FY 22 and will also be requested as part of the upcoming FY 23 budget development process. This recommendation has no staffing impacts beyond the normal budgeted scope of duties and is consistent with City Council priorities. There is no local job impact associated with this recommendation.
