TITLE

Recommendation to authorize City Manager to process a refund in the amount of $17,200 to Excelerate Housing Group, LLC, for a project located at 3590 East Pacific Coast Highway.  (District 3)

 

DISCUSSION

On February 20, 2020, Excelerate Housing Group, LLC, paid fees to the City of Long Beach (City) for plan check services and surcharges related to the preparation of an entitlement application for a Conceptual Site Plan Review and a Zone Change at 3590 East Pacific Coast Highway. However, it has since been determined that the project does not require a change in zoning or a standards variance and the applicant is eligible for a refund of $17,200.

 

In accordance with Long Beach Municipal Code Section 3.48.040, refunds exceeding $10,000 must be approved by the City Attorney and the City Council. Authorization to process the refund is requested on behalf of the applicant.

 

This matter was reviewed by Assistant City Attorney Dawn A. McIntosh on December 3, 2021 and by Budget Operations and Development Officer Rhutu Amin Gharib on December 5, 2021.

 

TIMING CONSIDERATIONS

City Council action is requested on January 4, 2022, to expedite processing of the refund.

 

FISCAL IMPACT

The approval of this recommendation will result in a refund of fees totaling $17,200 from the Development Services Fund Group in the Development Services Department. The requested action has no staffing impacts beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
