TITLE

Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend Contract No. 33664 with Ferguson US Holdings, Inc., formerly Ferguson Enterprises, Inc., of Pomona, CA, for furnishing and delivering as-needed plumbing supplies, to increase the contract amount by $150,000, for a total aggregate amount not to exceed $4,077,500, and extend the term of the contract to October 31, 2021.  (Citywide)

 

DISCUSSION

City Council approval is requested to amend Contract No. 33664 with Ferguson US Holdings, Inc. (Ferguson), for furnishing and delivering as-needed plumbing supplies, to increase the contract by $150,000, and extend the term to October 31, 2021. The unexpected impacts created by the COVID-19 pandemic has reduced City staff's capacity and ability to prepare and release a formal Invitation to Bid (ITB) for this complex set of specifications. This contract extension will provide adequate time to complete a formal solicitation in accordance with procurement policies and procedures.

 

At its meeting on January 6, 2015, the City Council adopted Specifications No. ITB LB15-010 and awarded a contract to Ferguson for as-needed plumbing supplies. On June 18, 2019, the City Council authorized a total interim contract of $516,500, and on July 14, 2020, the City Council amended the interim contract to increase the amount by $125,000, for a revised total contract amount not to exceed $3,671,500, and extended the term to December 31, 2020.

 

Most recently, on December 8, 2020, the City Council approved an amendment to increase the contract amount by $256,000, for a revised contract amount not to exceed $3,927,500, and extended the term of the contract to June 30, 2021.

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on April 12, 2021, Business Services Bureau Manager Tara Mortensen on April 6, 2021, and by Revenue Management Officer Geraldine Alejo on April 13, 2021.

 

TIMING CONSIDERATIONS

City Council action is requested on May 4, 2021, to ensure no interruption to services.

 

FISCAL IMPACT

The requested amendment will increase the contract amount with Ferguson by $150,000, for a revised total aggregate amount not to exceed $4,077,500, and extend the term of the contract to October 31, 2021. Sufficient funds are budgeted across various departments and fund groups.  This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. The extension of this contract will provide continued support to our local economy by assisting in preserving employment for 20 employees residing in Long Beach.
