TITLE
Recommendation to authorize City Attorney to pay sum of $925,000 in full settlement of lawsuit entitled Ray Webb v. City of Long Beach, et al; United States District Court Case No. 2:13-cv-9112-PL; United States Court of Appeals for the Ninth Circuit Case Nos. 17-56617, 18-55094.
DISCUSSION
Plaintiff brought this action alleging that Long Beach Police officers used unreasonable force while arresting him. A federal jury found in favor of plaintiff and awarded damages; the Court also awarded attorneys' fees. The officers filed Notices of Appeal to the Court of Appeals for the Ninth Circuit.
Following extensive settlement discussions, plaintiff agreed to accept $925,000 - inclusive of attorneys' fees and costs - as a full, global settlement of this case.
The settlement was discussed in closed session, and approved, by the Economic Development and Finance Committee on October 23, 2018.
