DISCUSSION
City Council approval is requested to execute a First Amendment to Contract No. 34242 (Project Agreement) with the City of Long Beach (City), the Board of Harbor Commissioners of the City of Long Beach (Port), and Plenary Properties Long Beach, LLC (Project Company), for the design, construction, financing, operation, and maintenance of the new City Hall, Main Library, Port of Long Beach Headquarters Building, and revitalized Lincoln Park, to amend the insurance requirements under Appendix 9 of the Project Agreement.

The Project Agreement requires the Project Company to maintain several different insurance policies with respect to the improvements to be constructed. The Project is being constructed by Clark Construction Group California - LP (Design-Builder). Due to certain corporate policies of the Design-Builder, the Project Company is, in a few instances, unable to provide insurance policies that meet the specific requirements of the Project Agreement. The Project Company, the City and the Port have negotiated amended insurance requirements that allow the Project Company to comply with the existing insurance policies of its Design-Builder, while at the same time adequately providing protection to the City, the Port and the project in general. City and Port Risk Management staff have reviewed and approved the revised insurance policy requirements, which, in some instances, provide for higher than required coverage limits.
