TITLE

Recommendation to authorize the City Manager, or designee, to execute a Public Walkways Occupancy Permit for sidewalk dining at Thai District restaurant, located at 149 Linden Avenue, Suite E.  (District 2)

DISCUSSION

The operator of Thai District restaurant, located at 149 Linden Avenue, Suite E, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining.  The proposed area and the list of furnishings and accessories to be placed in the permit area are shown on the attachment (Exhibit A).  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.

The current width of the sidewalk at this location is 14 feet.  A minimum clearance adjacent to the permit area will vary from 9 feet 2 inches between barricade and curb, and 5 feet between the barricade and street tree.

This matter was reviewed by the Development Services Building and Safety Bureau on December 5, 2016, by Deputy City Attorney Linda T. Vu on June 19, 2017, and by Revenue Management Officer Geraldine Alejo on June 21, 2017.

TIMING CONSIDERATIONS

City Council action is requested on July 18, 2017, so sidewalk dining may be permitted for the summer season.

FISCAL IMPACT

A permit processing fee of $616 was deposited in the General Fund (GF) in the Public Works Department (PW), and a security deposit of $580 was collected to ensure sidewalk repairs upon permit termination.  Approval of this recommendation will provide continued support to the local economy.
