TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Bo-Beau Kitchen located at 144 Pine Avenue.  (District 2)

DISCUSSION
Bo-Beau Kitchen requests a permit to temporarily occupy part of the adjoining sidewalk at 144 Pine Avenue, with portable fixtures for the purpose of sidewalk dining. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attachment. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.

The width of the sidewalk at this location is 22 feet, and an 8-foot clear path will be maintained between the streetlight, located immediately adjacent to the area of the proposed barricade, and the curb line, and a 10-foot clear path will remain between the permit area barricade and the curb line.

This matter was reviewed by Development Services Building and Safety Bureau on August 7, 2014, by Deputy City Attorney Linda Vu on April 8, 2015, and by Budget Management Officer Victoria Bell on April 9, 2015.

TIMING CONSIDERATIONS
Council action is requested for May 12, 2015 so that the sidewalk dining area can be constructed and ready for summer.

FISCAL IMPACT
A permit processing fee of $1,700 was deposited into the General Fund (GF) in the Public Works Department (PW) and a security deposit of $1,805 was collected to ensure sidewalk repairs upon permit termination. Approval of this recommendation will provide continued support to the local economy.

SUGGESTED ACTION
Approve recommendation.
