TITLE
Recommendation to approve the Assignment Consent Agreement for Facility/Pipeline Permit Nos. MW-31-91, MW-38-92, MW-56-94, MW-62-96, MW-145-03 and MW-232-10 from ExxonMobil Corporation to Circle K Stores, Inc., in accordance with Section 15.44.220 of the Long Beach Municipal Code. (Districts 3,5,6)
DISCUSSION
The ExxonMobil Corporation (Mobil) is requesting consent to assign its interest in Facility/Pipeline Permit Nos. MW-31-91, MW-38-92, MW-56-94, MW-62-96, MW-145-03 and MW-232-10 to Circle K Stores, Inc. (Circle K). The six permits are for a total of 10 existing groundwater monitoring wells, which are split among three different Mobil gas station locations in the City. See the three attached vicinity maps.
Staff recommends that this assignment be approved since Circle K has purchased the three gas stations from Mobil and it is required to continue the groundwater remediation with the wells. Since this is only a transfer of ownership with no use modifications, there will be no street excavations required for this action. Long Beach Municipal Code Section 15.44.220, Permit-Transfer, requires the assignee, Circle K, to provide the City an insurance policy and performance bonds for each permit. Their insurance and bonding will be processed following City Council's approval of the consent for assignment.
This matter was reviewed by Deputy City Attorney Linda Vu on October 10, 2014, and by Budget Management Officer Victoria Bell on October 22, 2014.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
There are no fees incurred for the transfer of ownership for these permits. There is no local job impact associated with this recommendation.
