TITLE

DISCUSSION
It is the goal of the Department of Public Works to widen public rights-of-way to the standards established in the City's General Plan. When projects requiring Site Plan Review are proposed, the public rights-of-way adjacent to the site are reviewed for sufficiency. For the remodeling of the Ralphs Market at 2930 East Fourth Street, the widening of the sidewalk along Fourth Street from 7.5 to 8.5 feet was required, as this is the minimum width that meets ADA requirements for a sidewalk with street trees.

In addition, this developer was required to provide 5-foot by 5-foot corner cut-offs at the intersection of the alleys running through the property. The east-west alley was relocated southerly through an alley vacation process completed in 2006, but the dedication of corner cut-offs was not included in that action. These corner cuts will facilitate vehicular turns.

The sidewalk widening and the alley corner cut offs have been completed. The Ralphs Grocery Company agreed to development conditions that include the above-described dedications as a part of Planning Department Case No. 0510-06. Both dedications are shown on the attached Exhibit A.

This matter was reviewed by Deputy City Attorney Amy R. Burton on April 30, 2008, and Budget Management Officer Victoria Bell on May 15, 2008. In conformance with the California Environmental Quality Act, Negative Declaration No. NO 27-05 was issued for this project.

TIMING CONSIDERATIONS
City Council action on this matter is not time critical.

FISCAL IMPACT
A document processing fee of $490 was paid by the developer and deposited in the General Fund (GP 100) in the Department of Public Works (PW).
