TITLE
Recommendation to authorize City Manager to execute the Second Amendment to Contract No. 29448 with Sully-Miller Contracting Company to increase the contract by $900,000 for a total cumulative contract amount of $15,400,000. (Citywide)

DISCUSSION
The City Council awarded the annual contract for street repairs and minor improvements to Sully-Miller Contracting Company on November 22, 2005, and authorized an amendment for the extension of the term and increase in unit prices on October 10, 2006 (attached as Exhibits A and B, respectively). Staff is requesting additional contract authority of $900,000 for a total cumulative contract amount of $15,400,000. The requested additional contract amount will allow for ongoing and anticipated asphalt, concrete, stormdrain and related time sensitive infrastructure improvements to be completed prior to the contract expiration date of December 31, 2007. The plans and specifications for a new annual contract are currently out for bid.

This is a procurement tool with no funds actually committed to the base contract. Upon City Council approval, departments will be issuing purchase orders within their respective operating or project budgets to fund their respective improvements to be done under this contract. City departments that are utilizing this on-call contract include Long Beach Gas and Oil, Long Beach Water, Community Development, Parks, Recreation and Marine and Public Works.

The proposed amendment was reviewed by Deputy City Attorney Lori A. Conway on September 20, 2007, and by Budget and Performance Management Bureau Manager David Wodynski on September 24,2007.

TIMING CONSIDERATIONS
City Council action is requested on October 2, 2007, to allow on-going street repair projects to proceed without interruption and allow for immediate commencement of new projects.
