TITLE
Recommendation to authorize City Manager to execute the Third Amendment to Contract No. 29041 with Damon Construction, Inc., for the Annual Contract for sidewalk repairs, curb ramps and related improvements, and increase the contract by $2,000,000 for a total amount of $13,000,000. (Citywide)

DISCUSSION
The City Council awarded the annual contract to Damon Construction, Inc., on December 7,2004, and authorized amendments for the extension of term on November 15, 2005, and again on November 14, 2006, for repair of the City's sidewalks, curb ramps and other related improvements (attached as Exhibit A, Band C, respectively).
The Contract provides for an "on-call" arrangement, whereby the contractor provides the City with fixed unit prices for the repair of sidewalks, curbs, gutters, driveway approaches, alleys and curb ramps. . The City issues work orders to the contractor for specific work at various locations. Upon the successful completion of a work order, additional work orders are assigned until all available funding for this type of work has been depleted.

This annual contract provides for an expedient means of constructing sidewalks, curb ramps, alleys and other related concrete work and is currently being used by the Departments of Public Works, Community Development and Parks, Recreation and Marine. Based upon the acceptable performance by the contractor and the contractor's agreement to comply with Section 3 requirements of the Community Development Block Grant Funding, staff is recommending exercising the City's option to increase the contract by $2,000,000, for a total contract amount of $13,000,000.

The requested additional contract amount will allow for completion of curb and gutter repair in the FY07 local street program. Staff has found it to be more cost effective to complete this work under the Damon contract, rather than under each local street improvement contract.
