TITLE
Recommendation to authorize Department of Planning and Building to process a refund in the amount of $12,217 to Vineyard Construction in accordance with Long Beach Municipal Code Section 3.48.040.
DISCUSSION
On August 7, 2006, Vineyard Construction paid for plan review and permit services in the amount of $33,404 to develop the property located on 1500 Pine Avenue, project number 467285. The applicant was charged for building plan check and permit based on the wrong value, which resulted in overcharging of fees to Vineyard Construction. Therefore, an approval to process a refund in the amount of $12,217 is requested on behalf of Vineyard Construction.
The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $10,000 be approved by the City Attorney and City Council.
This matter was reviewed by Assistant City Attorney Michael Mais on November 8, 2006 and Budget Management Officer David Wodynski on November 2,2006.
TIMING CONSIDERATIONS
City Council action on this item is requested on November 21, 2006, to expedite processing of the refund.
FISCAL IMPACT
The refund of $12,217 will be from the collected revenue from the overpayment received from Vineyard Construction. Therefore, there is no net impact to the General Fund.

Approve recommendation.
