TITLE

DISCUSSION
On September 23, 2005, Oak Creek Inns paid for plan review and permits for the property located on 4201 East Pacific Coast Highway, project number 413890. The applicant has abandoned the project due to increased construction cost and has requested a refund. An approval to process a refund in the amount of $10,057 is requested on behalf of Oak Creek Inns.
 
The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $10,000 be approved by the City Attorney and the City Council.
 
This matter was reviewed by Assistant City Attorney Michael Mais on October 4, 2006 and Budget Management Officer David Wodynski on September 26,2006.
 
TIMING CONSIDERATIONS
City Council action on this item is requested on October 17, 2006, to expedite processing of the refund.
 
FISCAL IMPACT
The refund of $1 0,057 will be paid from collected revenues held in trust for school
and strong motion instrumentation fees (i.e., $9,406), and from the General Fund
(i.e., $651).
