TITLE
Recommendation to authorize City Manager to execute a license agreement with Southern California Edison for use of Southern California Edison-owned right-of-way property.  (District 9)
 
DISCUSSION
Since October 1996, the City of Long Beach and Southern California Edison (SCE) have had a license agreement that permits the City to use SCE-owned right-of-way property, between Atlantic Avenue and Myrtle Avenue, north of 65th Street, for horticultural purposes (Attachment A). The license agreement will enable the City to permit the North Long Beach Neighborhood Association's use of the property as a community garden.
 
License Agreement No. 28276 expired September 30, 2006. SCE has requested a new agreement with the following provisions:
 
·      Term:      Five years, from October 1, 2006, through September 30, 2011.

Maintenance: The City is responsible for keeping the property free of weeds and trash. However, the North Long Beach Neighborhood Association will be assigned this responsibility upon receipt of authorization to execute a permit to use the property as a community garden.
 
This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on October 9, 2006, and Acting Budget Officer Greg Sorensen on October 4, 2006.
 
TIMING CONSIDERATIONS
City Council action is requested on October 17, 2006, to authorize the execution of a new license agreement.
 
FISCAL IMPACT
The Department will expend $1,846 in Fiscal Year 2007 (FY 07), and an additional $7,954 through FY 11. There are sufficient funds appropriated in the General Fund (GP) in the Department of Parks, Recreation and Marine (PR) to cover the FY 07 expenditure.
