TITLE
Recommendation to authorize Department of Planning and Building to process a refund in the amount of $7,034 to StarRibs South, LP in accordance with Long Beach Municipal Code Section 3.48.040.
 
DISCUSSION
On March 30, 2006, StarRibs South, LP (StarRibs) paid for plan review and permit services in the amount of $14,056 to develop the property located at 300 South Pine Avenue, project number 462593. The applicant was charged for stormwater review and permit based on the wrong value, which resulted in overcharging of fees to StarRibs. Therefore, an approval to process a refund in the amount of $7,034 is requested on behalf of StarRibs.
 
The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $5,000 be approved by the City Attorney and City Council.
 
This matter was reviewed by Assistant City Attorney Michael Mais on August 15, 2006 and Budget Management Officer David Wodynski on August 8, 2006.
 
TIMING CONSIDERATIONS
City Council action on this item is requested on September 5, 2006, to expedite processing of the refund.
 
FISCAL IMPACT
The refund of $7,034 will be from the collected General Fund revenue from the overpayment received from StarRibs. Therefore, there is no net impact to the General Fund.

Approve recommendation.
