DISCUSSION
In a memorandum dated November 1, 2005 (attached), the Chief of Police requests
suspension/ revocation of entertainment permit BU99041410 for Mariposa Restaurant
Group LLC, DBA Mariposa, 100 W. Broadway. The Police Department's request is
based on a five-year history of on-going nuisance activity, excessive calls for police
service, failure of licensee to comply with conditions of the entertainment permit, failure
of the licensee to accept responsibility for the nuisance activity and correct the
problems, and licensee's disobedience of City ordinances related to proper operation of
the business.
The Long Beach Municipal Code (LBMC) prescribes that, following a public hearing
before the City Council, a permit for entertainment may be revoked for any grounds
including but not limited to those that would warrant the denial of the permit if
application were being made; for failure to comply with any condition imposed on the
permit; or for maintaining a nuisance as defined in LBMC 21.15.1870. Whenever it is
provided that a hearing shall be heard by the City Council, the Council may, at its
discretion, either conduct the hearing itself or appoint a hearing officer to conduct the
hearing. When a permit for entertainment is revoked, no other entertainment
application by such permittee shall be considered for a period of one year.
This matter was reviewed by Deputy City Attorney Cristyl Meyers on December 9,2005.
