DISCUSSION
California State legislation AB-541 and SB-38 mandates that adults arrested for Driving Under the Influence (DUI) must attend a program involving individual case management and group education to prevent the reoccurrence of a DUI offense. The Department of Health and Human Services (DHHS) is licensed by the State Department of Alcohol and Drug Programs and is authorized by the County of Los Angeles Alcohol and Drug Program Administration (County) to provide these services. The DHHS has been providing DUI servids since 1978. Over 600 individuals receive services annually through this program.
 
The DHHS has two agreements with the County to provide services to first offenders and multiple offenders. These agreements expired on September 30,2005. The County has provided new agreements effective October 1, 2005 through September 30, 2010.
 
This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on October 10 , 2005 and Budget Management Officer David Wodynski on October 7,2005.
 
TIMING CONSIDERATIONS
City Council action is requested on October 18, 2005 in order to continue providing services under the new agreement.
 
FISCAL IMPACT
The agreements do not include funding. Participants in the program are required to pay fees that support the program. Revenue and expenses have been budgeted and no appropriation adjustment is required. The annual value ofthese agreements are $170,000 for the first offender program and $175,000 for the multiple offender program.
