TITLE

DISCUSSION
The Fiscal Year 2006 (FY 06) budget approved and adopted by the City Council on September 21, 2005, included an appropriation of $300,000 from an increase in the civil penalty charged for a street sweeping parking violation. An increase is requested to offset the ongoing cost of cleaning City streets and thoroughfares. The attached Resolution sets the penalty for a street sweeping violation to $39, an increase from the current $37. The new penalty is comparable with the current average of other California beach cities:

This matter was reviewed by Deputy City Attorney Lisa Peskay Malmsten and Budget Management Officer David Wodynski on September 22,2005.
 
TIMING CONSIDERATIONS
The hearing date of October 18, 2005 has been publicized in the local newspaper and posted pursuant to the municipal code.
 
FISCAL IMPACT
Additional revenue in the amount of $300,000 will be deposited into the General Fund. The budget appropriation was previously approved as part of the FY 06 budget.
