TITLE
Recommendation to receive supporting documentation into the record, conclude the public hearing and affirm the April 4, 2005 Hearing Officer Decision, and overrule the appeal of a gas-billing dispute by Dr. Willie Goffney. (District 3)
DISCUSSION
On April 4, 2005, a hearing was held to consider an Administrative Hearing Decision of October 29, 2004, regarding the appeal of Dr. Willie Goffney disputing charges for a natural gas bill of the City of Long Beach totaling $414.66.
On April 18, 2005, the Hearing Officer rendered a decision (attached) upholding the Administrative Hearing Decision that a gas usage adjustment was not authorized and that the appellant must bear financial responsibility for the subject gas usage charges.
On May 10, 2005, the City Council set this matter for hearing on May 24,2005. Long Beach Municipal Code section 2.93.050 (8) provides as follows: After review of the hearing officer's report, the City Council may adopt, reject or modify the recommended decision. In its discretion, the City Council may take additional evidence at the hearing or refer the case to the hearing officer with instructions to consider additional evidence.
