TITLE
Recommendation to authorize City Attorney to pay the sum of $7,500 in full and final resolution of the lawsuit entitled Norman Santini v. COLB.
DISCUSSION
Plaintiff alleges that on or about April 17, 2010, at or near 439 W. Fifth Street, he was walking on the north side of the sidewalk when he tripped on an unleveled section of sidewalk, resulting in injuries. Plaintiff seeks damages for same.
Plaintiff sustained soft tissue injuries and exacerbated pre-existing injuries as doctors have recommended he undergo a knee surgery. Plaintiff incurred approximately $12,000 in special damages.
The proposed settlement was presented to the Economic Development and Finance Committee on November 13, 2012 and was approved on that date. We therefore ask authority to pay the sum of $7,500 in full settlement of this claim against the City of Long Beach.
