TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Agaves Restaurant, located at 200 Pine Avenue, Suite A.  (District 2)
 
DISCUSSION
BA Group, Inc., the operator of Agaves restaurant, has requested a permit to temporarily occupy a part of the adjoining sidewalk at 200 Pine Avenue, with portable fixtures for the purpose of sidewalk dining.  The proposed permit area and a list of furnishings and accessories are shown on the attached.
 
Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.  The width of the sidewalk at this location varies from 16 feet to 22 feet. A minimum clearance of 5 feet will be maintained between the permit area and the existing street fixtures adjacent to the proposed permit area barricade.
 
This permit request was reviewed and approved by the Long Beach Fire Department on April 11, 2012.  This matter was reviewed by Deputy City Attorney Linda Trang on May 21, 2012, and by Budget Management Officer Victoria Bell on May 22, 2012.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on June 12, 2012, to accommodate the applicant's construction plans.
 
FISCAL IMPACT
A permit processing fee of $819 was deposited into the General Fund (GP) in the Department of Public Works (PW).  There is no local job impact associated with the recommendation.
 
SUGGESTED ACTION
Approve recommendation.
