TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Dale's Diner located at 4339 East Carson Street.  (District 5)
 
DISCUSSION
Min and Hong Corporation, the new owner of Dale's Diner, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining at 4339 East Carson Street.  Arturo Garcia, the previous owner, had a permit in good standing for over two years.  The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attachment. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.  The width of the sidewalk is 15 feet. A minimum clearance of at least 6 feet will be maintained between the permit area and other sidewalk obstructions.
 
Deputy City Attorney Linda Trang reviewed this matter and prepared the subject permit on February 16, 2011.  Budget Management Officer Victoria Bell reviewed this matter on March 30, 2011.  This permit request was reviewed and approved by the Long Beach Fire Department on February 9, 2011.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A security deposit of $546 and a permit processing fee of $546 were deposited into the General Fund (GP) in the Department of Public Works (PW).  Approval of this permit could have a positive impact on job creation.
 
SUGGESTED ACTION
Approve recommendation.
