TITLE
Recommendation to receive supporting documentation into the record, conclude the public hearing, find that the area to be vacated is not needed for present or prospective public use, adopt resolution ordering the vacation of Alta Way between Marietta Court and Olive Avenue, as well as a portion of Olive Avenue north of First Street. (District 2)
DISCUSSION
To allow for the construction of a 136-unit condominium complex, the developer, Sares Regis Group, requests the vacation of Alta Way between Marietta Court and Olive Avenue, as well as a portion of Olive Avenue north of First Street, reserving an easement on Olive Avenue (as shown on Exhibit A). Consistent with California land reversion practices and Chapter 3, General Vacation Procedure, of the Public Streets, Highways and Service Easements Vacation Law of the California Streets and Highways Code, the vacated portions of the public right of way will revert back to the adjacent property owner.
This matter was reviewed by Principal Deputy City Attorney Gary J. Anderson on March 25, 2016 and by Revenue Management Officer Julissa José-Murray on May 10, 2016.
TIMING CONSIDERATION
On May 3, 2016, the City Council adopted Resolution No. RES-16-0038, declaring its intention to vacate the subject right-of-way, and set May 24, 2016, as the date for the public hearing. A copy of the May 3, 2016, City Council letter is attached as Exhibit B.
FISCAL IMPACT
A final vacation processing fee of $9,908 was deposited to the General Fund (GF) in the Public Works Department (PW). There is no local job impact associated with this recommendation.
