TITLE
Recommendation to authorize City Manager to execute an Assignment Consent Agreement for Facility/Pipeline Permit No. P-132-81, from Raytheon Technical Services Company, LLC, to Linwood Avenue Limited Partnership, in accordance with Long Beach Municipal Code Section 15.44.220, Permit-Transfer. (District 8)
DISCUSSION
The Raytheon Technical Services Company, LLC is requesting consent to assign its interest in Facility/Pipeline Permit No. P-132-81, to Linwood Avenue Limited Partnership. The assignment consists of seventeen four-inch conduits totaling 1,054 linear feet. The conduits are for telephone, TV, alarm and other private communications. They cross under Hughes Way north of Warnock Way. Their locations are shown on the attached vicinity map.
Since this is only a transfer of ownership with no use modifications, there will be no street excavations required for this action. Long Beach Municipal Code Section 15.44.220, Permit-Transfer, requires the assignee, Linwood Avenue Limited Partnership, to provide the City an insurance policy and bonding for the permit. Their insurance is on file and their bonding will be processed following City Council authorization of the consent for assignment.
This matter was reviewed by Deputy City Attorney Linda Trang on July 20,2009, and by Budget and Performance Management Bureau Manager David Wodynski on July 20, 2009.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
The Linwood Avenue Limited Partnership will assume the annual fee for the pipeline permit, which is estimated to be $623. This fee will be deposited to the General Fund (GP) in the Department of Public Works (PW).
