TITLE
Recommendation to authorize the issuance of a refund in the amount of $5,350 to Friends of Tom Reeves.
DISCUSSION
The California Elections Code allows a candidate to withdraw hidher candidate statement on or before 5 p.m. the day following the close of the nomination period (January 17,2006). Because Tom Reeves was the only candidate for the office of City Prosecutor, he withdrew his candidate statement prior to the deadline of 5 p.m. January 17, 2006. The City Council appointed Mr. Reeves to the Office of City Prosecutor on January 25,2006.
TIMING CONSIDERATIONS
City Council action is requested on February 7, 2006, to avoid further delay in processing the refund.
FISCAL IMPACT
There is no fiscal impact as candidates pay to have their candidate statement printed in the sample ballot booklet. Since Mr. Reeves' statement will not be printed, costs associated with it will not be realized.
