TITLE

Recommendation to authorize City Manager to execute a Second Amendment to Agreement No. 33765 with the firm of Rutan & Tucker, LLP for legal services related to labor negotiations.

DISCUSSION

On October 11,2014, the City Attorney's Office issued a purchase order, Agreement No. 33765 with the firm of Rutan & Tucker for legal services in the amount of $200,000 related to labor negotiations with the International Association of Machinists and Aerospace Workers ("Machinists"). On July 7, 2015, the City Council authorized a First Amendment to the Agreement in the amount of $75,000. We have reached the threshold allotted under the Agreement. The City Council is requested to authorize the City Manager to execute a Second Amendment for an additional $150,000 in order that Rutan & Tucker may continue to represent the City's interests in ongoing labor negotiations with the Machinists and related PERB Charges.

FISCAL IMPACT

Funding is available in the General Fund in the department of Citywide Activities due to lower than projected contractual obligations in other programs.

SUGGESTED ACTION

Approve recommendation.

Respectfully Submitted,

CHARLES PARKIN

CITY ATTORNEY
