Type: SA-Conformed Contract Status: CCIS
File created: 7/17/2012 In control: City Clerk
On agenda: Final action: 7/17/2012
Title: FIRST AMENDMENT TO CONTRACT - AMEND CONTRACT TO FORMALLY RECOGNIZE EXPENDITURE OF CONTIGENCY APPROVED BY REDEVELOPMENT AGENCY ON 5/16/2011 BY AMENDING CONTRACT TO INCLUDE SUCH CONTINGENCY (NOTE: PURSUANT TO THE DISSOLUTION OF RDA, EFFECTIVE 2/1/2012, A NEW SUCCESSOR AGENCY CONTRACT NUMBER HAS BEEN ASSIGNED TO THIS AMENDMENT, ALSO SEE RDA CONTRACT #WS 313) (NOTE: PER CITY ATTORNEY, The Olsson contract was approved by the RDA in 2011, in the full amount of the contract PLUS the contingency (approximately $3.9 million). The actual contract was written to authorize only the contract amount (without contingency). The EOPS adopted by the SA & approved by the OB & the DOF did INCLUDE the entire amount of the contract including contingency. Given that, it is the opinion of this office that amending the contract was a ministerial act & that further SA action was not required. That explains why there is no SA agendized action associated with the extension of the Olsson Contract
