DISCUSSION
Walnut Avenue between 3rd Street and Pacific Coast Highway is in need of pavement repair work. This pavement rehabilitation project is eligible for federal funding and is currently being designed. In order to obtain federal funding, an agreement known as a Program Supplement needs to be executed by the administering agency (Caltrans) and the City of Long Beach.

Formerly, Caltrans issued the funding agreement prior to the award of a construction contract. Staff would request execution of the agreement at the time City Council awarded the construction contract. Caltrans has initiated a new procedure, which requires the City to execute the funding agreement at the time the project design is authorized.

Staff has received authorization from Caltrans to design the pavement repair work on Walnut Avenue and is requesting that the City Council authorize the City Manager to execute the funding agreement. In the future, when the City receives authorization from Caltrans to construct the project, a new funding agreement will not be necessary. The additional federal funds to reimburse construction and construction engineering will be added to the funding agreement at that time.

This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on August 12, and Budget Management Officer David Wodynski on August 10, 2005. In accordance with the California Environmental Quality Act, Categorical Exemption Number CEP 69603 has been issued for this project.
