TITLE
Recommendation to authorize Department of Development Services to process a refund in the amount of $17,656 to Yann Toy Chau for the property located at 1821 Myrtle Avenue. (District 6)
DISCUSSION
On October 1, 2015, Yann Toy Chau (Applicant) paid fees totaling $17,656 to cover expenses and fees related to an Administrative Use Permit, Site Plan Review, and Standards Variance for proposed artists’ lofts at 1821 Myrtle Avenue. The Applicant has withdrawn the application prior to a significant review of the proposed project. In accordance with Long Beach Municipal Code (LBMC) Section 3.48.030, the Applicant is eligible for a full refund of $17,656.
In accordance with LBMC Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, authorization to process the refund is requested on behalf of the Applicant.
This matter was reviewed by Assistant City Attorney Michael Mais on January 27, 2016 and by Budget Management Officer Victoria Bell on February 2, 2016.
TIMING CONSIDERATIONS
City Council action is requested on February 23, 2016, to expedite processing of the refund.
FISCAL IMPACT
The amount of $17,656 will be refunded from the Development Services Fund (EF 337) in the Department of Development Services (DV). There is no local job impact associated with this recommendation.
