TITLE
Recommendation to authorize a revision of the Café Sevilla public walkways occupancy permit for sidewalk dining to include a canopy at 140 Pine Avenue.  (District 2)
 
DISCUSSION
On November 1 , 2005, the City Council authorized a permit for Cafe Sevila at 140 Pine Avenue for the occupation of a portion of the adjacent public sidewalk for sidewalk dining. On February 18, 2006, Ordinance No. ORD-06-0009, which amended the Municipal Code by deleting the seasonal restriction on canopies , became effective. The owners of Cafe Sevilla request modification of the existing permit to allow placement of a permanent canopy over their dining patio.
 
The proposed canopy area, a list of furnishings and canopy details are shown on the attached Exhibit A, and special requirements for canopies are attached as Exhibit B. Approval of this permit is based on the standards established by Chapter 14 of the Long Beach Municipal Code.
 
Canopy plans were approved by the Planning and Building Department on February 1, 2006, and the Long Beach Fire Department on February 8 , 2006. The Redevelopment Agency reviewed and approved the color of the canopy fabric sample. The revised permit was prepared by Deputy City Attorney Lisa Peskay Malmsten on May 3, 2006.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on May 16, 2006 , in order to coordinate permit approval with the proposed restaurant opening.
 
FISCAL IMPACT
No additional fee is required at this time.

Approve recommendation.
