TITLE
Recommendation to authorize City Attorney to pay sum of $7,218.49 in full settlement of lawsuit entitled Enterprise Rent A Car vs. City of Long Beach.

DISCUSSION
This case involves an automobile accident which occurred on March 1 I 2006 at Linden Avenue prior to the intersection of San Antonio Road. The claimant's vehicle was legally parked along the curb when it was struck by an unmarked police car. The officer driving the police car stopped the vehicle in order to pursue a suspect on foot when he exited the vehicle it did not come to a complete stop. The insured's vehicle was a 2006 Buick Lucerne which sustained moderate front end damage.

After negotiations, the parties tentatively agreed to a full and complete settlement, inclusive of all costs and fees in the amount of $7,218.49.

The proposed settlement was presented to the Economic Development and Finance Committee on August 15,2006 and was approved on that date. We therefore ask authority to pay the sum of $7,218.49 in full settlement of this claim against the City of Long Beach.

SUGGESTED ACTION
