TITLE

Recommendation to authorize the Department of Planning and Building to process a refund in the amount of $5,224.88 to Lodgeworks, LP in accordance with Section 3.48.040 of the Long Beach Municipal Code.

 

DISCUSSION

On November 1,2004, Lodgeworks, LP prepaid for an environmental impact review (EIR) and a traffic study for the Sierra Hotel in the Pike at Rainbow Harbor Project area in the amount of $51,550. The service costs incurred for the review, study, and associated fees and surcharges totaled $46,325.12, which resulted in an overpayment of $5,224.88 by Lodgeworks, LP. Therefore, an approval to process a refund in the amount of $5,224.88 is requested on behalf of Lodgeworks, LP.

 

The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $5,000 be approved by the City Attorney and City Council.

 

This matter was reviewed by Assistant City Attorney Michael Mais on February 17, 2006 and Budget Management Officer David Wodynski on February 14,2006.

 

TIMING CONSIDERATIONS

Action is requested at the March 7,2006 City Council meeting, to expedite processing of the refund.

 

FISCAL IMPACT

The refund of $5,224.88 will be from the collected overpayment of EIR services received from Lodgeworks, LP. The total amount will be refunded from the General Fund and the trust account where the prepayment is held.

 

SUGGESTED ACTION

Approve recommendation.
