TITLE
Recommendation to authorize City Manager to execute a license agreement with Southern California Edison for use of Southern California Edison-owned property at the El Dorado Nature Center.
(District 5)

DISCUSSION
For more than 23 years, the City of Long Beach and Southern California Edison (SCE) have had a license agreement that permits the City to use Edison-owned property, located on the westerly edge of the EI Dorado Nature Center, for park purposes. The most recent license agreement expired on June 30, 2005, and SCE is requesting City execution of a new agreement.

The proposed agreement contains the following terms and conditions:

Term: Five years, commencing on July 1,2005
Fee: $2,954 per year
Maintenance: City maintenance of trees at heights no greater than those prescribed by SCE, which depends on the type of tree and its location.

This letter was reviewed by Senior Deputy City Attorney Donna Gwin on July 1, 2005, and by Budget Management Officer David Wodynski on July 6, 2005.

TIMING CONSIDERATIONS
City Council action is requested on July 19, 2005, to authorize the execution of this license agreement.

FISCAL IMPACT
Sufficient funds to cover these costs are budgeted in the General Fund (GP) in the Department of Parks, Recreation and Marine (PR).
