TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary for the Second Amendment to License Agreement No. 32052 with Los Cerritos Wetlands Authority, a California Joint Powers Authority, to allow for continued access over and through City-owned property located at Second Street and Shopkeeper Road. (District 3)

DISCUSSION
On January 4, 2011, the City Council authorized License Agreement No. 32052 (License Agreement) with Los Cerritos Wetlands Authority (LCWA) for use of a City-owned access road, located at Second Street and Shopkeeper Road, more commonly referred to as the Marketplace Marsh (Access Area), for a period of five years. The LCWA, of which the City is a member, owns an approximately 40-acre property to the east of the Access Area, but has no direct access from any public right-of-way. On June 23, 2015, the City Council authorized a five-year extension of the License Agreement, through June 30, 2020. As the term of the License Agreement has ended, LCWA has requested an extension of the License Agreement to allow for its continued access to its property via the Access Area. Therefore, a Second Amendment to the License Agreement is required.

The proposed Second Amendment to the License Agreement will contain the following major terms and provisions:

· Licensor: City of Long Beach, a municipal corporation.

· Licensee: Los Cerritos Wetlands Authority, a California joint powers authority.

· Amended Term: The term of the License Agreement will be extended for five years, through June 30, 2025.

· Renewal Option: One, five-year renewal option, at the discretion of the City Manager.

This matter was reviewed by Deputy City Attorney Richard F. Anthony on July 27, 2020. Due to time constraints, no Budget Office review was able to be conducted.

TIMING CONSIDERATIONS
City Council action is requested on August 18, 2020, to allow LCWA to continue to access its property via the Access Area.
