DISCUSSION
The developer of a new Walgreens Pharmacy at 5400 Cherry Avenue requires three driveways for this 1.2 acre site in order to accommodate both customer and delivery truck access. In 1980, this parcel was restricted to only one driveway through the recordation of Parcel Map No. 8598, based upon a specific development that never occurred. The configuration of the current proposed driveways is shown on the attachment, and has been approved by the City Traffic Engineer and the Planning Bureau.
 
Based upon the review and approval of the City Traffic Engineer and the Planning Bureau, it is recommended that the City eliminate the access restrictions regarding the Walgreens development parcel and allow the City Traffic Engineer and the Planning Bureau to exercise their usual discretion to review and approve new driveway locations for this site according to City standards. This can be accomplished by executing a quitclaim of the access rights restrictions to the property owner, Cherry Market RX Corp, a California corporation.
 
This letter was reviewed by Deputy City Attorney Linda Trang on June 3, 2008 and Budget Management Officer Victoria Bell on June 11, 2008. In conformance with the Environmental Quality Act, Categorical Exemption No. 06-241 was filed.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
