DISCUSSION
 
Watt Management Co., 2140 Technology Place, Long Beach, CA, paid for a Business License on November 3, 2005 in the amount of $6,702. On November 9, 2005, Watt Management Co. again paid $6,702. A refund has been requested in the amount of $6,702.
 
City of Long Beach Municipal Code Section 3.48.040 (C), requires that a refund exceeding $5,000 be approved by the City Attorney and the City Council. On December 13, 2005, the City Council approved an amendment to the Municipal Code increasing the limit of payments of refunds requiring City Council approval of refunds in excess of $10,000.
However, this amendment is not yet effective.
 
This matter was reviewed by Assistant City Attorney Michael J. Mais and Budget Management Officer David Wodynski on December 21,2005.
 
TIMING CONSIDERATIONS
City Council action is requested on January 3, 2005 to avoid further delay in processing the refund.
 
FISCAL IMPACT
The source of the funding for the refund will be collected revenue from Watt Management Co.; therefore, there is no net impact to the General Fund.
 
SUGGESTED ACTION:
Approve recommendation.
