TITLE
Recommendation to authorize City Attorney to pay the sum of $20,000 in full settlement of the lawsuit entitled Maria Croucier v City of Long Beach, Case No. NC055323.
 
DISCUSSION
On April 20, 2010, Maria Croucier tripped and fell on a City Sidewalk near 3848 Gaviota Avenue.  Plaintiff alleged that late afternoon shadows concealed the uneven portion of the sidewalk.
 
Croucier sustained a torn Achilles tendon that required a surgical repair, which did not heal properly.  She underwent several weeks of would debridement.  Her total medical specials are in the $140,000 range and she makes a lost earnings claim of approximately $10,000.
 
Following settlement discussion, all parties have agreed to settle this matter with the City paying $20,000.  The proposed settlement was presented to the Economic Development and Finance Committee on September 4, 2012, and was approved on that date.
