TITLE
Recommendation to authorize City Manager to execute any and all documents necessary for the First Amendment to Agreement No. 31079 with the Wyland Foundation for refurbishing the marine life mural, "Planet Ocean," to include an "Earth: The Blue Planet" mural on the Arena roof of the Long Beach Convention and Entertainment Center, located at 300 East Ocean Boulevard.  (District 2)

DISCUSSION
On April 7, 2009, the City Council approved Agreement No. 31079 with the Wyland Foundation to refurbish a marine life mural, Planet Ocean, on the exterior wall of the Arena at the Long Beach Convention and Entertainment Center (Center). The environmental artist, Robert Wyland, and his crew have successfully completed the work.

The Wyland Foundation extended an offer to paint a new mural on the arena roof entitled, "Earth: The Blue Planet." The work was completed as part of an Earth Day event and brought national attention to Long Beach. Like the recently refurbished Planet Ocean mural, the artist Wyland and his staff painters completed the new roof top mural at no cost to the City.

An amendment to the existing agreement is required to set forth the same terms and conditions for the The Blue Planet mural as was agreed upon for the Planet Ocean m u ra I.

This letter was reviewed by Principal Deputy City Attorney Charles Parkin and Budget and Performance Management Bureau Manager David Wodynski on April 23, 2009.

TIMING CONSIDERATIONS
City Council action is requested on May 5, 2009 to ensure that recently completed work is immediately incorporated into the existing City Council approved Agreement No.
31079 with the Wyland Foundation.
