TITLE

Recommendation to authorize City Attorney to pay the sum of $7,500 in full settlement of lawsuit entitled Simmons v. City of Long Beach.

DISCUSSION

On April 24, 2003, Plaintiff, an individual confined to a wheelchair, encountered a traffic sign post that was implanted in the middle of the sidewalk in violation of the Americans with Disabilities Act.  The post was subsequently relocated.  The above settlement includes damages and statutorily recoverable attorneys fees.

SUGGESTED ACTION

Approve recommendation.
