TITLE

IA Interior Architects, for the property located at 3880 Kilroy Airport Way.  (District 5)
 
DISCUSSION
On November 15, 2011, Andrew Roskos, with IA Interior Architects, paid planning, building, and fire plan check fees totaling $41,800, based on a construction valuation of $2,853,000, for tenant improvements at DeVry University.  Interior Architects later informed the Department of Development Services that they inadvertently provided incorrect construction valuation and that the correct construction valuation was $1,073,000, decreasing planning, building, and fire plan check fees to $18,440, resulting in a refund of $23,360.  Department of Development Services staff reviewed and confirmed the revised valuation was correct.  
 
In accordance with Long Beach Municipal Code, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, an approval to process the refund is requested on behalf of the applicant.
 
This matter was reviewed by Deputy City Attorney Richard Anthony on March 14, 2012 and Budget Management Officer Victoria Bell on March 29, 2012.
 
TIMING CONSIDERATIONS
City Council action is requested on April 17, 2012 to expedite processing of the refund.  
 
FISCAL IMPACT
The amount of $15,991 will be refunded from the Development Services Fund (SR 137) and $7,369 will be refunded from the Long Beach Fire Department's General Fund (GP100).  There will be no local job impact as a result of the recommended action.
