TITLE
Recommendation to authorize City Attorney to pay sum of $19,000 in full settlement of lawsuit entitled Shirley Turner vs. City of Long Beach.
DISCUSSION
Plaintiff, mother of Decedent, Guanda Denise Turner, alleges wrongful death of her daughter out of an incident that arose on January 31, 2002. The police officers stopped the decedent to question her after receiving complaints of her drug dealing activities. A physical struggle between the officers and the decedent ensued. Thereafter, the decedent died a few days later.
During a court ordered Mandatory Settlement Conference, the parties tentatively agreed to a full and complete settlement, inclusive of all costs and fees in the amount of $19,000.00, with no admission or determination of liability.
The proposed settlement was presented to the Economic Development and Finance Committee on March 1, 2005 and was approved on that date. We therefore ask authority to pay the sum of $19,000.00 in full settlement of this claim against the City of Long Beach.
