TITLE
Recommendation to authorize City Attorney to pay the sum of $20,000 in full settlement of lawsuit entitled McKinley v The City of Long Beach, et al., Case No. TC025579.
DISCUSSION
This suit arises out of a traffic accident where plaintiff was rear-ended while stopped at a red light by a City dump truck driven by a City employee in which plaintiff sustained approximate property damages of $20,000 and $16,000 in economic damages.
During subsequent settlement discussions after the case failed to settle at mediation, plaintiff agreed to accept $20,000 as full settlement, subject to City Council approval.
The Economic Development and Finance Committee approved the proposed settlement on June 12, 2012.
