Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at La Creperie Café located at 130 N. Pine Avenue.  (District 2)      
 
DISCUSSION
La Creperie Pine, Inc. is opening a new La Creperie Café at 130 Pine Avenue. They have requested a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining as occupied by the previous tenant (Hooters).  The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attachment.  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.  The width of the sidewalk at this location is 22 feet, and a seven-foot wide path will be maintained between the sidewalk-dining area and the curb without obstruction.
 
The Long Beach Fire Department reviewed and approved this request on June 16, 2011.  Deputy City Attorney Linda Trang prepared the subject permit on June 23, 2011, and Budget Management Officer Victoria Bell reviewed this item on June 27, 2011.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A security deposit of $819 and a permit-processing fee of $819 were deposited into the General Fund (GP) in the Department of Public Works (PW).  There will be no local jobs impacted by this recommendation.
 
SUGGESTED ACTION
Approve recommendation.
