TITLE
Recommendation to authorize Department of Development Services to process a refund in the amount of $12,254 to Anthony Williams, Darrick Knight, and Gail Knight in accordance with Long Beach Municipal Code Section 3.48.040. (District 5)
DISCUSSION
On September 28,2007, Anthony Williams, Darrick Knight, and Gail Knight paid for plan check and permit fees in the amount of $12,254 for the property located on 6815 East Wardlow Road, project number 494692. The applicant has cancelled the project and no inspections have been made. Therefore, an approval to process a refund in the amount of $12,254 is requested on behalf of the applicants.
The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $10,000 be approved by the City Attorney and City Council.
This matter was reviewed by Assistant City Attorney Michael Mais on May 14, 2008, and Budget Management Officer Victoria Bell on May 23, 2008.
TIMING CONSIDERATIONS
City Council action on this item is requested on June 17, 2008, to expedite processing of the refund.
FISCAL IMPACT
The refund amount of $12,254 will be refunded from the Development Services Fund (SR 137) where the collected fees were deposited.

Approve recommendation.
