TITLE
Recommendation to authorize City Manager to execute a new Fitness Provider Permit with Andrea Rodrigues, dba Yogalution Movement, for the provision and operation of outdoor yoga classes and personal fitness activities at the Bixby Park Annex for a term of three years. (District 2)

DISCUSSION
In March 2015, Andrea Rodrigues, dba Yogalution Movement (YM), submitted a completed Fitness Provider Application to the Department of Parks, Recreation and Marine (PRM) requesting the use of Bixby Park Annex, on the corner of Ocean Boulevard and Junipero Avenue, for the provision and operation of outdoor yoga classes.

YM classes will initially consist of weekly yoga classes at Bixby Park Annex. YM will locate and operate at Bixby Park Annex; however, it shall not operate in a way that impedes foot traffic or otherwise disrupts the use of the park by other patrons. YM will be responsible for ensuring that any items brought and used pursuant to its permitted use are removed promptly at the conclusion of each class.

· Permitted Use: The provision and operation of outdoor yoga classes within City parks during posted use hours, while adhering to noise and impact abatement conditions consistent with the Long Beach Municipal Code, and/or as directed by the City Manager or his designee.

· Permit Areas: Bixby Park Annex, on the corner of Ocean Boulevard and Junipero Avenue (Attachment). YM may request use of additional City parks and/or beach sites. Each additional site shall be subject to review and prior approval, and will be at the discretion of the City Manager or his designee.

· Permit Fee: YM shall pay PRM an annual permit fee of ...
