TITLE
Recommendation to request an amendment to the Long Beach Municipal Code to prevent merchandise from garage sales from being displayed on the sidewalk or parkway due to safety issues arising from the obstruction of the public right of way.

DISCUSSION
The City of Long Beach regulates garage sales in order to prevent garage sales from becoming a nuisance to the community.

The current Municipal Code defines "garage sale" as the sale of or offering for sale the personal property of any person, where such personal property is set out for public display and sale in any open garage, yard, or patio of any building or premises which contains one or more dwelling units.

I would like to request that the Municipal Code be amended to explicitly prohibit the display of merchandise on sidewalks and parkways in order to prevent garage sale merchandise from obstructing the public right of way.

SUGGESTED ACTION
Approve recommendation.

Respectfully Submitted,

BONNIE LOWENTHAL, VICE MAYOR, FIRST DISTRICT
